We started noticing this trend earlier last year when several of our clients brought us copies of civil lawsuits filed by private student loan lenders. Coincidentally all the lawsuits were filed by National Collegiate Student Loan Trust. Fortunately my clients brought these lawsuits before the 28 days had run. We were able to file an answer timely. This is the key: if you get a law suit or court papers on your student loans run to a lawyer. Do not run and hide. There is a deadline to take action. We were able to obtain favorable results for our clients.
These lawsuits maybe attacked as the party suing may not have the right to sue. They may not hold the right paper. They may not even be able to prove you owe the money.
These lawsuits are designed for them to take judgment as quickly as possible. Once they have judgment, they can begin to garnish wages and attache assets. Do not wait.
If they have obtained a judgment do not panic. You may still have options but you need to see a lawyer to review the matter. The judgments maybe subject to attack and could be overturned.
This article written by fellow NACBA member Richard Gaudreau examines the war launched by the private student loan companies against the borrowers.
Additionally the borrower may have bankruptcy options to deal with these loans.
